Svinka’s Terms and Conditions

Welcome to Svinka.com (the “Service”). These Terms & Conditions (“Terms”) govern your use of the services provided through the website svinka.com (the “Site”). By using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

  • 1. General Provisions

    • 1.1. Eligibility: The Service is intended solely for individuals aged 18 or older who are permanent residents of the United States. Services are not available to residents of other countries.
    • 1.2. Operator: The technical platform, operational activities, and fulfillment are managed by Svinka LLC, a Wyoming limited liability company (the "Company").
    • 1.3. Communications: By subscribing to the Service, you consent to receive electronic communications from us (e.g., transaction receipts, shipping updates, and marketing materials). You may opt-out of marketing emails at any time.
  • 2. Core Service and Subscription

    • 2.1. Description: The Artist (“Svinka”) creates original illustrations. Subscribers receive physical, professionally printed copies (postcards) of these artworks delivered by mail.
    • 2.2. Subscription Model: By signing up, you authorize Svinka LLC to charge your payment method on a recurring basis. The standard subscription includes one postcard every two weeks.
    • 2.3. Automatic Renewal: Your subscription will automatically renew at the frequency and price disclosed during signup until you cancel.
    • 2.4. Pricing and Taxes: Subscription fees are fixed at the time of purchase. We reserve the right to change pricing for future periods with 30 days' notice. Prices do not include sales tax. We will collect and remit sales tax where required by applicable state and local laws based on your shipping address. In jurisdictions where we do not collect sales tax, you may be responsible for reporting and paying use tax.
  • 3. Payment and Billing

    • 3.1. Payment Attempts: We make up to two (2) attempts to process payment for each mailing. If payment fails, the postcard will not be sent.
    • 3.2. Suspension: If payment fails for four (4) consecutive mailings, your subscription will be suspended until updated billing information is provided.
    • 3.3. Voluntary Tips: Users may leave voluntary tips. Tips are strictly non-refundable and do not constitute a purchase of additional services or goods.
  • 4. Shipping and Delivery

    • 4.1. Address Accuracy: You are responsible for providing a correct and complete shipping address. Any changes to the address must be submitted to artist@svinka.com at least four (4) days prior to the scheduled mailing date. The Company is not responsible for items sent to an outdated or incorrect address provided by the subscriber.
    • 4.2. Third-Party Fulfillment: Items are dispatched via the United States Postal Service (USPS). Once an item is handed over to the carrier, the Company is not liable for delays, delivery failures, theft, or damage caused by the carrier or external factors.
  • 5. Intellectual Property

    • 5.1. Ownership: All artistic content, designs, and visual materials on the postcards and the Site are the sole intellectual property of the artist Svinka and Svinka LLC.
    • 5.2. Permitted Use: You are granted a limited, personal license to enjoy the physical postcards and to share photographs of them on personal social media accounts, provided that such sharing is non-commercial and does not involve high-resolution scanning or reproduction.
    • 5.3. Prohibited Use: Commercial resale of the postcards, high-resolution reproduction, redistribution, or any other commercial use of the artwork without express written permission is strictly prohibited.
  • 6. Cancellation and Refund Policy

    • 6.1. Cancellation: You may cancel your subscription at any time by contacting us at artist@svinka.com. Cancellation stops future charges but does not refund past payments except as stated in Section 6.2.
    • 6.2. Satisfaction Guarantee: We offer a "no questions asked" refund for the last processed payment only. Refund requests must be submitted within 30 days of the transaction.
    • 6.3. Chargeback Policy: You agree to contact us at artist@svinka.com and follow the Dispute Resolution process (Section 8) before initiating a chargeback with your bank. In the event of an unjustified chargeback, we reserve the right to terminate your subscription.
  • 7. Limitation of Liability

    • 7.1. "As Is" Basis: The Service is provided without warranties of any kind, either express or implied.
    • 7.2. Damages Cap: To the maximum extent permitted by law, Svinka LLC’s total liability for any claim arising out of these Terms shall not exceed the total amount paid by you to the Service in the three (3) months preceding the claim.
  • 8. Dispute Resolution and Arbitration

    • 8.1. Mandatory Informal Resolution: You agree to attempt to resolve any dispute in good faith by contacting us for at least 14 days before initiating formal action.
    • 8.2. Binding Arbitration: Any dispute arising from these Terms will be settled by binding arbitration in the State of Wyoming, under the rules of the American Arbitration Association (AAA).
    • 8.3. Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
  • 9. Governing Law

    These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of laws principles.
